Following an investigation by the Insolvency Service, a disqualified director from West Yorkshire has recently been handed a further ban of 11 years.

Despite his disqualification, the disqualified director continued to act as a director of his new business and failed to resign as a director at Companies House. The investigation also found that the new business had traded to the detriment of HMRC, who were owed over £176,000, whilst cash of over £97,000 was withdrawn from the company’s bank account and not accounted for by the director.

The Insolvency Service remain vigorous in their pursuit of directors who ignore their disqualification undertakings and continue to act as directors (or in the management of a business in breach of the terms of their disqualification). If in doubt, seek advice on applying for leave to continue to act as a director, despite disqualification.
