TUPE Transfers: The Basics
TUPE protects employees when the business or undertaking for which they work transfers to a new employer. It is important for employers to recognise when a TUPE situation arises and to be clear on the different obligations a business involved in the transaction may owe to the workforce.
TUPE is an acronym for the Transfer of Undertakings (Protection of Employment) Regulations 2006. Where TUPE applies, employees automatically transfer from one employer to another with their terms of employment and continuity of service intact.
